These Terms of Service (“Terms”) govern your access to and use of the NavioTrack website, software platform, mobile applications, APIs, and related services (collectively, the “Services”), operated by NavioTrack (“we”, “us”, or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

 


 

1. Eligibility & Account Registration

You must be at least 18 years old and legally capable of entering into a binding agreement to use our Services.

You are responsible for:

  • Providing accurate and complete information
  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account

 


 

2. Scope of Services

NavioTrack provides:

  • GPS tracking and fleet management software
  • Mobile applications
  • APIs and integrations
  • Analytics, alerts, and reporting tools
  • Optional customization, white-label, and enterprise solutions

Service features may vary depending on your plan, agreement, or subscription.

 


 

3. Customer Responsibilities

You agree that you will:

  • Use the Services only for lawful purposes
  • Comply with all applicable local, national, and international laws
  • Obtain all necessary consents from drivers, employees, or end users
  • Ensure GPS devices are installed and used legally

NavioTrack does not assume responsibility for improper or unlawful use of tracking technology.

 


 

4. GPS & Location Data Usage

NavioTrack processes GPS and tracking data on behalf of the customer.

You acknowledge that:

  • You are the data controller for location data collected using the Services
  • You are responsible for informing tracked individuals
  • You must comply with privacy, labor, and surveillance laws applicable in your jurisdiction

NavioTrack does not sell or use location data for advertising purposes.

 


 

5. Subscriptions, Fees & Payments

5.1 SaaS Subscriptions

  • Subscription fees are billed per vehicle or as agreed
  • Billing cycles may be monthly or annual
  • Fees are non-refundable unless stated otherwise in writing

5.2 One-Time License / Enterprise Services

  • Custom pricing applies
  • Scope, support, and maintenance terms will be defined in a separate agreement

We reserve the right to modify pricing with prior notice.

 


 

6. Free Trials & Demos

Any free trial or demo access is provided on an “as-is” basis and may be limited in duration or features. We may suspend or terminate trial access at any time.

 


 

7. Intellectual Property

All intellectual property rights related to NavioTrack Services, including software, logos, designs, documentation, and trademarks, are owned by NavioTrack or its licensors.

You may not:

  • Copy, modify, or reverse engineer the Services
  • Resell or sublicense without written authorization
  • Use our branding without permission

 


 

8. Third-Party Services & Hardware

NavioTrack may integrate with third-party services, APIs, or GPS hardware.

We are not responsible for:

  • Third-party availability or performance
  • Hardware malfunctions
  • External service interruptions

Use of third-party services is subject to their respective terms.

 


 

9. Service Availability & Modifications

We strive for high availability but do not guarantee uninterrupted service.

We may:

  • Update, modify, or discontinue features
  • Perform maintenance or upgrades
  • Suspend access for security or operational reasons

 


 

10. Data Security & Backups

We implement industry-standard security measures. However, you acknowledge that:

  • No system is entirely secure
  • You are responsible for maintaining your own backups unless otherwise agreed

 


 

11. Termination & Suspension

We may suspend or terminate your access if you:

  • Violate these Terms
  • Fail to pay applicable fees
  • Use the Services unlawfully or abusively

You may terminate your subscription according to your plan terms.

Upon termination:

  • Access to Services will cease
  • Certain data may be deleted in accordance with our data retention policy

 


 

12. Disclaimer of Warranties

The Services are provided “as is” and “as available”.

NavioTrack disclaims all warranties, including:

  • Fitness for a particular purpose
  • Accuracy of data
  • Uninterrupted or error-free operation

 


 

13. Limitation of Liability

To the maximum extent permitted by law, NavioTrack shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business
  • Claims arising from misuse of the Services

Our total liability shall not exceed the amount paid by you in the preceding 12 months.

 


 

14. Indemnification

You agree to indemnify and hold harmless NavioTrack from claims arising out of:

  • Your use of the Services
  • Violation of laws or third-party rights
  • Failure to obtain required consents

 


 

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of USA, without regard to conflict-of-law principles.

 


 

16. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date.

Continued use of the Services constitutes acceptance of the updated Terms.
